View Full Version : NEW, LIFTED trucks sold through local dealers?
A friend of a friend just purchased a new truck from JN...
So we all know that military guys have more money than they know what to do with LOL. One of my buddies got a very good bonus, so he went down to J&N and bought a brand new Silverado with a 6" suspension lift and big tires. The air pressure monitoring system does not work, and the speedo is way off. Plus there is no RECON on it.
He paid like $48K for the truck! For that price it should all work. He took it in today and they tried to fix the air sensor, but when the mechanic called GM tech they told him that the warranty is void with the lift and tires. So they are trying to come up with a work around, and they say they'll honor the warranty in-house. They'll look into it on the RECON.
This all seems crazy to me for a near fifty large truck. Anyone have any thoughts? How much does RECON cost? They did give him a free trip to Vegas for two with the truck.

Second-hand truck. Modified by the original buyer, then turned in.
To be honest, your friend got ripped, IMO. I'm sure they'll try to help your
friend to the best of their ability, because they definitely don't want to
give him back his money.
Trip for two to Vegas? hmmmm....

Your friend should get a lawyer reagrding the sale...
As far a voiding the warranty he should familarize himself with this bit of legislation. It usually does take a lawyer to help drive this with the Mfg...

The Magnuson-Moss Warranty Act (15 U.S.C. 2302(C))
This federal law regulates warranties for the protection of consumers. The essence of the law concerning aftermarket auto parts is that a vehicle manufacturer may not condition a written or implied warranty on the consumers using parts or services which are identified by brand, trade, or corporate name (such as the vehicle maker's brand) unless the parts or service are provided free of charge. The law means that the use of an aftermarket part alone is not cause for denying the warranty. However, the law's protection does not extend to aftermarket parts in situations where such parts actually caused the damage being claimed under the warranty. Further, consumers are advised to be aware of any specific terms or conditions stated in the warranty which may result in its being voided. The law states in relevant part:
No warrantor of a consumer product may condition his written or implied warranty of such product on the consumers using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name... (15 U.S.C. 2302(C)).

i agree with outsider that they'll probably do the best they can to help out but... if they can't... they usually won't.

I don't know about the truck being lifted
looks like it's at about the stock HD height...
but w/ different tires and wheels.
Brandon, thats NOT a HD, its a Vortec MAX CCSSB (like my blue one)
IIRC thats a 6" lift plus the tires.
TPMS is mandatory since 2006 (I think) so it HAS to be there.

Nope... AFAIK, that truck was modified by the dealer and sold AS NEW.
I asked and havent gotten an answer yet.

Before everyone goes jumping the gun...
There are several situations and each has a different resulting answer;
1) The dealer made the modifications to a brand new vehicle and said vehicle was sold as "new vehicle".
2) The dealer made the modifications to a brand new vehicle and said vehicle was sold as "demo vehicle" ("USED" in the text of Hawaii law).
3) The dealer made the modifications to a used vehicle and sold it as a "used vehicle".
4) The dealer either purchased the vehicle at auction or as a trade in, and made no further modifications, then sold the vehicle as a "used vehicle".
When the owner posts his answer... then the answer can be debated...
imho
the dealer sold it to them modified...they should have taken care of legalities BEFORE the owner took possession.
but that's just because of what i am hearing on a daily basis.

remember when the guys buying the scion xB's were needing to go to recon cause of the factory authorized trd parts they were buying (w/ their new vehicles).
Isn't this kind of the same thing(if it's a "factory" lift- kind of like an extreme 2" drop)

brand new dem vehicles need to have at least 1500 miles on the odo or something around there to be sold as "USED"
by the looks of the S/C 12 blue... issused 12/06 ...guess they couldnt see it so they added stuff on, to justisify the higher price
thats not even close to a FACTORY lift, 6inch lift?

the truck didn't look that high, basically the same height as a 4x4 hd... what made it look a little taller was the wheel / tire package..
wish i could get a better look at it.

Guess it comes down to what the current OWNER was told, and what it says on the papers he signed. Unless anyone here was there to hear what was said, or unless we can see the paperwork he signed when purchased, we'll never know what the solution should be. And looks like he has until either December or February to solve it, before the Safety Check expires.

NEw SC is good for 2 years, HOWEVER...
We know that SC is also revokable if the vehicle is deemed "unsafe" by our laws...
Vehicle can be grounded and/or towed as a result.
EDIT: Maybe that can be PART of the solution...
Get stopped, tagged for no recon, and grounded. Have the vehicle towed to the dealer to correct problems THEY created.
I can call a buddy at Maui Off Road and see what the scoop on the truck is.
ugh...Maui Off Road. they suck Rob...they are one of the guys that CREATE the most problems.
